(herein after called KT / KFW)

Introduction
The general terms and conditions apply to all courses, workshops, training sessions, consultations, coaching sessions and other services of KT / KFW. Third party services, even if they are arranged by KT / KFW, do not come under these general terms and conditions. The general terms and conditions can only be amended in writing; verbal amendments are neither valid nor acknowledged.

Conclusion of the contract
The contract materializes:
• with an individual written contract of KT / KFW;
• or with verbal and personal planning of the programme of both parties;
• if services are utilized with the agreement of KT / KFW

Safety
KT / KFW makes high demands in the selection and education of the trainer/guide. In planning the training sessions, safety aspects are considered to be very important.

Physical and psychological capability of the participant
The services offered by KT / KFW sometimes make high demands on the physical and psychological capability of the participant. If a participant feels he or she is not up to these demands, it is his of her responsibility to inform the trainer/guide of this. If he or she takes part, nevertheless, this is on his or her responsibility.

Use of equipment and facilities
Equipment and facilities of KT / KFW and third parties used for training must only be used when accompanied by the authorised trainer/guides of KT / KFW. All participants must be aware of the dangers in using any equipment. The orders of trainer/guides and safety personnel shall be strictly obeyed.

Liability
In the design of facilities and training courses all steps were taken to reduce possible dangers as much as possible. All participants must be aware of the risks involved in outdoor training sessions, even with all safety measures taken.
The use of facilities is at one’s own risk, each user is responsible for complying with the necessary safety measures. KT / KFW excludes any liability when the safety regulations are disregarded. Also, the participants are liable for all other services of KT / KFW, such as workshops, consultations, coaching sessions,

Scope of services
The scope of services is paraphrased and confirmed or verbally agreed in the special conditions of the individual contract. Services agreed upon are settled, regardless whether they are actually utilized. Amendments on part of KT / KFW are possible with advance notice. If courses cannot take place due to force majeure (accident, illness etc of trainer/guides as well as weather-related damage to outdoor equipment) KT / KFW shall refund amounts paid in. By no means shall KT / KFW shall continue to be liable.
Any liability is excluded for third party services, even if the third party is arranged by KT / KFW.


Attendance
Attendance is agreed verbally in the framework contract and/or the individual contract and is binding. For the services of third parties, even if these have been arranged by KT / KFW, the conditions of the respective third parties apply.

Cancellation/Nullification
If a contract is cancelled/nullified and this cancellation/nullification is not through the fault of KT / KFW, the following are accounted.

• 120-90 days before the booked event: 50% of costs
• 89-60 days before the booked event: 75% of costs
• 59-0 days before the booked event: 100% of costs

If KT / KFW cannot carry out the training and further education steps, possible advance payments are refunded. However, there is no continued claim against KT / KFW.

Prices/Payment terms
The agreed prices are exclusive of VAT and any other taxes possible, unless otherwise mentioned. Expenses of trainer/guides, safety personnel etc. are not included in the prices and are invoiced separately. The special conditions of KT / KFW wage scales apply.
Invoices are immediately payable on receipt, net terms only. Invoices shall be paid no later than 10 days before the course starts.

Subletting
Subletting equipment and facilities by customers of KT / KFW is not allowed.

Hotel/Overnight stays
The course prices do not include any overnight costs. It is up to the customer to arrange accommodation e.g. hotel reservation. A list of possible accommodation can be requested from KT / KFW.

Catering
Catering is only included in the course price if this has been specifically agreed.

Facilities
The use of facilities outside of training is not permitted. Any liability is rejected in cases such as these.

Insurances
It is recommended to take out cancellation cost insurance; this is up to the customer.
The customers undertake to ensure that all participants have the necessary insurance, particularly third-party, accident and health insurance.

Dates
KT / KFW makes the dates and privacy protection a top priority. Each participant has the right to examine all course evaluations concerning him/her. No dates, evaluations or profiles will be forwarded to third parties without the written permission of the participant. For the purpose of research, data may be evaluated and forwarded anonymously. If a participant is not in agreement, he/she can demand for this data to be destroyed following written notification.

Law and court of jurisdiction
Swiss law applies Langnau i.E. is agreed as court of jurisdiction.
